He also noticed a strong odor of an alcoholic beverage coming from the vehicle. When asked if he or his passenger had consumed any alcoholic beverages prior to driving, both said “no.”

The deputy asked Walls to step out of the vehicle, and when he did, it became evident to Daugherty that the odor of alcohol was coming from Walls breath when he spoke. He was asked again if he had consumed any alcoholic beverage prior to driving and he allegedly said that he did consume one 12 ounce beer.
