LAFOLLETTE, TN. (WLAF)- Herschel A. Terry wrecked his truck and then went to jail on Sunday.

Campbell County Deputy Anthony Mahar noticed the black Nissan in a ditch on Highway 25 W just after 8:30 am. It was in a ditch and the driver, Terry, was attempting to drive it out of the ditch but was only succeeding in spinning the tires, the report said. As Mahar investigated the scene, he found a female in the passenger’s seat who said she was injured and a six- year-old boy in the back seat. The child wasn’t wearing a seatbelt nor was he in a child safety seat.

Terry, who was allegedly acting “nervous,” according to the report, continued to try to get the truck out of the ditch while insisting he didn’t need a crash report, Mahar’s report said.  This led to Terry taking, and failing, a field sobriety test.

When Terry was searched following his arrest, Mahar allegedly found a glass pipe and a small black container with three pills in it on Terry.

The pills were Xanax, Terry allegedly confessed.

Terry, 49, 132 Terry Lane, Duff, is charged with second offense DUI, possession of a controlled substance, possession of drug paraphernalia, child endangerment and violation of the implied consent law. (WLAF NEWS PUBLISHED 1/8/20 6AM)
