NEWCOMB, TN (WLAF) – A Dodge Dakota was traveling near sunset on Capuchin Rd. in Newcomb when Campbell County Deputy Christopher West noticed the vehicle. The pick-up truck had increasing speed then immediately decreasing speed.

It also used excessive breaking patterns on a straight roadway and failed to maintain the same level of travel, according to a report from the sheriff’s department. West also allegedly noticed a strong odor or marijuana coming from the vehicle. Through pacing West was able to determine the vehicle was traveling more than 10 miles per hour over the speed limit.

West stopped the vehicle and spoke with the driver who was identified as Nathan Leon Waller. The man told West he was smoking marijuana while he was following him and allegedly told him he had marijuana in his possession. West noticed Waller had a concealed handgun and removed the weapon from him, unloaded it and placed it in the front seat of the Dodge Dakota. Waller then failed the field sobriety tests.

When was Waller was told he was under arrest for driving under the influence (DUI), he attempted to leave the scene on foot. West commanded the man to stop, but he did not. When West was able to stop Waller, he was placed under arrest.

Waller, 49, 3006 Hwy 297, Newcomb, was charged with driving under influence (DUI) second offense, evading arrest, resist stop frisk halt search, unlawful carrying or possession of a weapon, possession of a handgun under the influence, possession of schedule VI controlled substance, speeding, disorderly conduct and other.
